Welcome to Aifer. These Terms of Service (the "Terms") govern your use of our website aifer.uk and your purchase of products from us. Please read them carefully.

By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

3. Our Status as a Trader

We are a limited company registered in England and Wales. We sell luxury made-to-order clothing to consumers. These Terms are designed to comply with the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, and the Digital Markets, Competition and Consumers Act 2024 .

Nothing in these Terms affects your statutory rights as a consumer.

4. Made-to-Order Nature of Our Products

4.1 How Our Drops Work

All items sold on this website are made to order. When you place an order during a collection drop, we do not hold these items in stock. Instead, we begin the process of crafting your specific piece with our manufacturing partners .

4.2 Production Timeline

  • Production Time: Approximately 4–6 weeks from the closure of the order window.

  • Dispatch to Us: Your item is shipped to us once production is complete (within the 4–6 week period).

  • Dispatch to You: Within 1–2 business days of us receiving your order.

4.3 No Right to Cancel for Change of Mind (After 48 Hours)

Under the Consumer Contracts Regulations 2013, goods made to the consumer's specifications are exempt from the usual 14-day cooling-off period . While we offer a voluntary 48-hour grace period (see Section 7), after this window closes or production begins, you cannot cancel, return, or exchange an item for change of mind, including for sizing issues.

5. Contract Formation

5.1 When a Contract is Made

Placing an item in your basket does not constitute an order. A contract between us is only formed when:

  1. You place an order and complete checkout;

  2. We send you an email confirming your order (the "Order Confirmation"); and

  3. The 48-hour grace period has passed or production has commenced.

5.2 Order Validation

We reserve the right to refuse or cancel orders for any reason, including:

  • The product is unavailable due to production limits;

  • Payment is not authorised or suspected fraud;

  • Pricing or description errors.

If we cancel your order after payment, we will issue a full refund.

6. Pricing and Payment

6.1 Prices

All prices are in Pounds Sterling (£) and include VAT where applicable at the current rate . If you are a business customer, VAT will be shown separately.

6.2 Payment Methods

We accept payment via Stripe, PayPal, Shopify Payments, Klarna. Payment is taken at the time of order.

6.3 Import Duties (International Customers)

If you are ordering from outside the UK, you may be subject to import duties, taxes, and customs clearance fees. These are your responsibility and are not included in the price paid at checkout .

7. Cancellation Rights (Our 48-Hour Grace Period)

Under UK law, made-to-order goods like ours are typically exempt from the 14-day cooling-off period . This means we are not legally required to offer cancellations for change of mind.

However, as a gesture of goodwill to our Aifer community, we offer a 48-hour grace period.

  • Within 48 hours of placing your order: If you change your mind for any reason, email us at contact@aifer.uk. We will cancel your order and issue a full refund.

  • After 48 hours have passed: Your order will have entered our production queue. At this stage, the order is final and cannot be cancelled, returned, or exchanged for a change of mind. This includes situations where the item does not fit or you decide you no longer want it.

8. Returns, Refunds, and Faulty Goods

8.1 Faulty or Incorrect Items (Your Statutory Rights)

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 . You are always entitled to a remedy if the goods you receive are:

  • Faulty (defect in materials or workmanship);

  • Not of satisfactory quality;

  • Not as described (e.g., wrong colour or fabric);

  • Not fit for purpose .

What to do: Contact us immediately at contact@aifer.uk with your order number, a description of the issue, and photographs. We will provide a full refund (including original shipping costs) upon the safe return of the item .

8.2 Change of Mind After 48 Hours

We do not accept returns or issue refunds for change of mind after the 48-hour grace period has passed. This includes sizing issues. Please check our size guide carefully before ordering.

8.3 Return Shipping for Faulty Items

If we agree that an item is faulty or incorrect, we will provide instructions for returning it. We will cover reasonable return postage costs .

9. Shipping, Delivery, and Risk

9.1 Delivery Timeframe

9.2 Risk and Title

  • Risk: The item is at your risk from the moment it is delivered to you .

  • Title (Ownership): We retain ownership of the goods until we receive full payment .

9.3 Lost or Damaged in Transit

We are responsible for the goods until they are delivered to you . If your order is lost or arrives damaged:

  • Damaged: Contact us within 48 hours with photos.

  • Lost: Contact us if your tracking shows no movement beyond the estimated delivery date.

We will pursue claims with the courier and issue a refund or replacement (if available) .

10. Liability and Disclaimers

10.1 Our Liability to Consumers

We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence .

We do not exclude or limit our liability for:

  • Death or personal injury caused by our negligence;

  • Fraud or fraudulent misrepresentation;

  • Breach of your statutory rights under the Consumer Rights Act 2015;

  • Any other liability that cannot be excluded by law.

10.2 Force Majeure

We are not liable for failure to perform our obligations if such failure is caused by events outside our reasonable control (e.g., material shortages, strikes, natural disasters, pandemics, or supplier issues).

11. Intellectual Property

All content on our website—including text, graphics, logos, images, and software—is the property of Aifer Limited or its licensors and is protected by UK and international copyright laws.

You may not reproduce, distribute, or use any content without our express written permission.

12. Privacy and Data Protection

We respect your privacy and are committed to protecting your personal data.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, Made-to-Order Policy, and Shipping Policy, constitute the entire agreement between you and Aifer Limited.

13.2 Severability

If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right under these Terms does not constitute a waiver of that right.

13.4 Transfer of Rights

We may transfer our rights and obligations under these Terms to another organisation. We will notify you if this happens.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales .

Any dispute arising from or relating to these Terms or your purchase from us will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer and resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts .
